Developer hereby disclaims any and all liability for:
a) Content published, displayed, or distributed through websites developed for Client; Products or services offered through Client's website; c) Business operations, practices, or conduct of Client; d) Client's compliance or non-compliance with applicable laws and regulations; e) Accuracy, completeness, or legality of information provided by Client; f) Any transactions conducted through Client's website; g) Client's data collection, storage, or processing practices.
3. INDEPENDENT CONTRACTOR STATUS
Developer acts solely as an independent contractor providing technical website development services. Developer is not:
a) A partner in Client's business; b) Responsible for Client's business decisions or operations; c) Liable for Client's compliance with industry regulations or legal requirements.
4. CLIENT RESPONSIBILITIES
Client acknowledges and agrees that they are solely responsible for:
a) All content published on their website; b) Ensuring compliance with applicable laws and regulations; c) Obtaining necessary licenses, permits, and authorizations; d) Maintaining appropriate security measures; e) Processing customer data in accordance with privacy laws; f) Managing all business operations and customer relationships.
5. INDEMNIFICATION
Client agrees to indemnify, defend, and hold harmless Developer from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from Client's website content, business operations, or any breach of applicable laws or regulations.
6. GOVERNING LAW
This disclaimer shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions.
